Terms of Service

1. Acceptance of Terms

By accessing and using Roleplayr ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Roleplayr is a role-playing game management platform that allows users to create, organize, and manage characters, locations, events, and other game elements. The Service includes features for campaign management, world-building, and collaborative storytelling.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use this Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

4. User Content

You retain all rights to content you create, upload, or share on Roleplayr ("User Content"). By submitting User Content, you grant Roleplayr a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content and represent that:

  • You own or have the necessary rights to all User Content you submit
  • Your User Content does not violate any third-party rights
  • Your User Content does not violate any applicable laws

5. AI-Generated Content

Roleplayr provides artificial intelligence and machine learning features that generate content based on your inputs, including but not limited to character descriptions, location details, storylines, and images (collectively "AI-Generated Content").

Accuracy and Reliability

Artificial intelligence and machine learning are rapidly evolving technologies. Due to the probabilistic nature of these systems, AI-Generated Content may not always be accurate, complete, reliable, or appropriate for your intended use. When you use our AI features, you understand and agree that:

  • AI-Generated Content may not accurately reflect real people, places, facts, or events
  • You must not rely on AI-Generated Content as a sole source of truth or factual information
  • You must evaluate all AI-Generated Content for accuracy, appropriateness, and suitability before using or sharing it
  • AI-Generated Content may contain errors, inconsistencies, or inappropriate material despite our best efforts to prevent this
  • We make no guarantees about the quality, accuracy, or suitability of AI-Generated Content for any particular purpose

Your Responsibilities

You are solely responsible for:

  • All inputs you provide to our AI systems, including ensuring you have the necessary rights to any source material
  • Reviewing and verifying AI-Generated Content before using, sharing, or publishing it
  • Ensuring your use of AI-Generated Content complies with all applicable laws and third-party rights
  • Any consequences arising from your use of AI-Generated Content
  • Complying with applicable disclosure requirements if you publish or distribute AI-Generated Content

Prohibited Uses

You must not:

  • Represent that AI-Generated Content was created entirely by you without AI assistance when making commercial use of such content
  • Use AI-Generated Content in ways that could deceive or mislead others about its nature or origin
  • Use AI-Generated Content to infringe upon the intellectual property rights of others
  • Use AI-Generated Content for any illegal, harmful, or abusive purposes
  • Attempt to "jailbreak," manipulate, circumvent, or otherwise misuse our AI systems in ways not aligned with their intended purpose of generating tabletop role-playing game content
  • Use prompt injection, adversarial inputs, or other techniques to cause AI systems to generate content outside their intended scope or bypass safety measures

Ownership and License

To the extent permitted by law, you own the AI-Generated Content you create using the Service. However, due to the nature of AI systems, similar or identical content may be generated for other users. Our ownership assignment does not extend to content generated for other users.

We reserve the right to use your inputs and AI-Generated Content to maintain, improve, and develop our Services, comply with applicable law, enforce our policies, and keep our Services safe.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Roleplayr and are protected by international copyright, trademark, and other intellectual property laws.

Roleplayr respects the intellectual property rights of others. We respond to notices of alleged copyright infringement and will terminate accounts of repeat infringers.

7. Third-Party Game Systems and Trademarks

Roleplayr is designed to work with various tabletop role-playing game systems, including but not limited to Dungeons & Dragons® 5th Edition, Pathfinder®, Call of Cthulhu®, and other systems. All game system names, logos, and related trademarks are the property of their respective owners.

This product is an independent tool for game organization and management and is not affiliated with, endorsed by, sponsored by, or approved by any game publisher or rights holder. Roleplayr does not claim any ownership or rights to these game systems or their intellectual property.

Users are responsible for ensuring that any content they create or upload complies with the licenses and terms of use of their chosen game systems, including any Open Gaming Licenses (OGL), Community Content Agreements, or similar licensing frameworks.

8. Prohibited Uses

You agree not to use the Service:

  • In any way that violates applicable laws or regulations
  • To transmit harmful, offensive, or inappropriate content
  • To impersonate or attempt to impersonate Roleplayr or another user
  • To engage in any automated use of the system without permission
  • To interfere with or disrupt the Service or servers
  • To attempt to gain unauthorized access to the Service
  • To harass, abuse, or harm other users
  • To attempt to jailbreak, manipulate, or circumvent our AI generation systems or use them in ways not aligned with their intended purpose
  • To use prompt injection, adversarial techniques, or other methods to bypass safety measures or content filters in our AI systems

9. Subscription and Payments

Some features of the Service may require a paid subscription. Subscription fees are billed in advance on a recurring basis. You will be charged at the beginning of your subscription period and on each renewal date.

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial periods.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings.

11. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Roleplayr does not warrant that the Service will be uninterrupted, timely, secure, or error-free. We do not warrant that the results obtained from use of the Service will be accurate or reliable.

12. Limitation of Liability and Indemnification

Limitation of Liability

IN NO EVENT SHALL ROLEPLAYR, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service, including AI-Generated Content
  • Unauthorized access, use, or alteration of your content
  • Any errors, inaccuracies, or inappropriate content in AI-Generated Content

OUR AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE THAT GAVE RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE LIABILITY AROSE OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold harmless Roleplayr, its affiliates, and personnel from and against any costs, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from third-party claims related to:

  • Your use of the Service or AI-Generated Content
  • Your User Content or any content you submit to the Service
  • Your violation of these Terms or any applicable laws
  • Your infringement of any third-party intellectual property or other rights
  • Any harm caused to third parties by your use of AI-Generated Content

13. Changes to Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Roleplayr shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms of Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Roleplayr operates, without regard to its conflict of law provisions.
